Bar examiners should hang their heads in shame for not harnessing the available technology to deliver the exam remotely. It is an embarrassment of epic proportions that those at the helm of legal licensure are so behind the times.
The Court recognized that without a means to pass the bar and obtain a law license, qualified students who expect to graduate this spring may lose job offers, be unable to find legal work, and otherwise suffer financial hardship.
Law schools quickly went online, trained faculty on use of technology, and adopted pass-fail grading. There is no reason for bar examiners to not be as creative and willing to implement emergency protocols.
